WOODY AUCTION TERMS & CONDITIONS

 

The lots listed will be offered by Woody Auction as agent for consignor subject to the following terms and conditions.  Where Woody Auction is the agent, the contract is between seller and buyer.  The following conditions of sale and terms of guarantee constitute the entire agreement with the purchaser relative to the property listed in catalogue listing, web listing, flyer, and etc. 

By bidding at auction you agree to be bound by these terms:

TERMS AND CONDITIONS OF SALE :

  1. All items sell without reserve unless otherwise noted.
  2. All lots are sold “AS IS” and neither the auctioneer nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, description, genuineness, authorship, attribution, provenance, period, culture, source, origin or condition of the property and no statement at the sale, or in bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability.
  3. Prospective buyers are strongly advised to examine personally any property in which they are interested before the auction takes place to determine its condition, size, and whether or not it has been repaired or restored.  All measurements and weight are approximate.
  4. Woody Auction reserves the right to withdraw any lot at any time prior to the commencement of bidding for such lot and shall have no liability whatsoever for such withdrawl.
  5. The auctioneer reserves the right to reject any bid, to refuse admission to the premises, or participation in any auction at our discretion.  In the case of a disputed bid between bidders, the auctioneer shall have sole discretion in determining the purchaser, and may also withdraw the lot or re-offer the lot for sale.  The highest bidder acknowledged by the auctioneer will be the purchaser.
  6. The auctioneer has the absolute discretion to divide any lot, to combine any two or more lots, to withdraw any lot, to refuse any bid, and to regulate the bidding.

ABSENTEE POLICY

  1. Woody Auction undertakes the execution of absentee bids as a convenience for clients and is not responsible for failure to execute bids, or for any error in the execution of bids. He may bid on the absentees behalf for all goods being offered subject to his discretion.
  2. After January 1, 2007, a 10% absentee bid fee will be added to the hammer price of each item sold. 
  3. To submit an absentee bid, simply list the lot number(s), description and maximum bid amount on the Absentee bid form.  Bids will be accepted in whole dollar amounts only. 
  4. The auctioneer will bid competitively on the absentee’s behalf, purchasing the lot for the lowest price possible.  Due to the nature of competitive bidding, this may result in a lot being sold to a person on the floor at or just below your maximum bid amount.
  5. Absentee tie bids are decided in favor of the earliest postmark or fax date.
  6. All bid requests must be received in the office by 12:00 p.m. on the day preceding the start of the auction to participate.

SUCCESSFUL BIDS

  13.   Successful bidders will be notified and invoiced the week following the auction.

      A complimentary price list is given to those who were successful in their bids.

SHIPPING

   14.   Shipping is separate from the total of the invoice.  A credit card will be requested to ensure the exact amount for postage, insurance, and materials.

   15.   Items are shipped through United States Postal unless request for a different shipper.
